1. Overview
This website is operated by Welby Supply Co. ("we," "us," or "our"). Throughout the site, the terms "you" and "your" refer to you, the user or customer.
By visiting welbysupply.com, browsing our products, or placing an order, you agree to these Terms of Service, along with our Privacy Policy and Refund Policy, which are incorporated here by reference. If you do not agree to these terms, please do not use this site.
We may update these terms at any time. Changes take effect when posted to this page. Continuing to use the site after changes are posted means you accept them. Please check this page periodically.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to make a purchase. By placing an order you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorized to use it.
You may not use our products or site for any unlawful purpose, or in a way that violates any law or regulation in your jurisdiction.
3. Products
We do our best to display our products accurately, but we cannot guarantee that your screen shows colours exactly as they appear in real life. Dimensions, weights, and capacities are approximate unless stated otherwise.
Products are subject to availability. We may discontinue any item at any time. We reserve the right to limit quantities, and to limit or refuse sales to any person, region, or jurisdiction at our discretion.
4. Product safety and intended use
Please use every product for its intended purpose and follow any instructions or warnings supplied with it.
- Children's and baby products are not substitutes for adult supervision. Inspect them regularly and stop using anything that shows damage or wear.
- Electrical products should be used only as instructed, with the correct power supply, and never left unattended while in operation.
- Tools and outdoor equipment should be used with appropriate care and protective equipment.
If a product arrives damaged or seems unsafe, stop using it and contact us straight away.
5. Pricing and errors
All prices are in US dollars and may change without notice. Prices do not include sales tax or shipping unless stated at checkout.
We try to keep pricing and product information accurate, but errors happen. If an item is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed at that price, even after the order has been confirmed and your payment method charged. If we cancel an order for this reason, we will refund you in full.
6. Orders
Receiving an order confirmation email does not mean we have accepted your order. We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear to be placed by resellers or dealers, orders that appear fraudulent, or orders with billing details we cannot verify.
If we cancel your order, we will notify you at the email or phone number provided and refund any amount charged.
You agree to provide current, complete, and accurate purchase and account information so we can process your order and contact you if needed.
7. Payment
Payment is taken at checkout. We accept the payment methods shown at checkout, processed securely through Shopify Payments. We do not see or store your full card details.
You are responsible for any bank, card issuer, or currency conversion fees your provider charges.
8. Shipping and delivery
Delivery estimates shown at checkout or on product pages are estimates, not guarantees. Delays caused by carriers, customs, weather, or events beyond our control are not within our responsibility, though we will always help you track down a delayed order.
Risk of loss passes to you when the carrier delivers the item to the address you provided. Please make sure your shipping address is correct — we cannot be responsible for orders sent to an address entered incorrectly.
9. Returns and refunds
Returns and refunds are governed by our Refund Policy, which forms part of these terms. In short: you have 60 days from delivery to return an unused, undamaged item, and return shipping is your responsibility except where an item arrives damaged, faulty, or incorrect.
10. Prohibited uses
You may not use this site or its content:
- For any unlawful purpose, or to solicit others to perform unlawful acts
- To violate any regulation, rule, law, or local ordinance
- To infringe upon our intellectual property rights or those of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other malicious code
- To collect or track the personal information of others
- To spam, phish, pharm, pretext, spider, crawl, or scrape
- To interfere with or circumvent the security features of the site
We may terminate your use of the site for violating any of these.

Our site may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, accuracy, policies, or practices. Please review their terms before engaging with them.
14. Disclaimer of warranties
The site and everything on it is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
We do not warrant that the site will be uninterrupted, secure, timely, or error-free, or that results obtained from using it will be accurate or reliable.
Nothing in these terms excludes or limits any warranty, right, or remedy that cannot be excluded or limited under applicable law, including rights you may have under state consumer protection statutes.
15. Limitation of liability
To the fullest extent permitted by law, Welby Supply Co. and its officers, employees, and agents will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or any product purchased through it, including lost profits, lost data, or replacement costs.
Where liability cannot be excluded, our total liability to you will not exceed the amount you paid for the product giving rise to the claim.
Some states do not allow the exclusion or limitation of certain damages. In those states, our liability is limited to the maximum extent permitted by law. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

You agree to indemnify and hold harmless Welby Supply Co. and its officers, employees, and agents from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or the rights of a third party.

These terms remain in effect unless and until terminated by either you or us. You may terminate by ceasing to use the site. We may terminate at any time without notice if we believe you have breached these terms, and you will remain liable for all amounts owed up to that date.
19. Governing law
These terms are governed by the laws of the Commonwealth of Kentucky and the United States, without regard to conflict of law provisions. Any dispute will be brought in the state or federal courts located in Kentucky, and you consent to their jurisdiction.
20. Entire agreement
These Terms of Service, together with our Privacy Policy and Refund Policy, make up the entire agreement between you and Welby Supply Co. and supersede any prior agreements or communications.
Any ambiguity in these terms will not be construed against us as the drafting party.
